Pirate Bay lawyers demand retrial

Lawyers of four men convicted of running The Pirate Bay file-sharing website are seeking a retrial, saying the judge had a conflict of interest.

Judge Tomas Norstrom is a member of the Swedish Copyright Association and sits on the board of Swedish Association for the Protection of Industrial Property.

But the judge has told Swedish Radio: "These activities do not constitute a conflict of interest."

Sweden's Court of Appeal would rule on a possible retrial, the lawyers said.

Frederik Neij, Gottfrid Svartholm Warg, Carl Lundstrom and Peter Sunde were found guilty of breaking copyright law on 17 April 2009 and sentenced to a year in jail.

The four were also ordered to pay $4.5m (£3m) in damages to a number of entertainment companies, including Warner Bros, Sony Music Entertainment.

Peter Althin, who represents The Pirate Bay (TPB) spokesman Peter Sunde, said it was for the appeal courts to decide if there was to be a retrial, as it emerged the judge and lawyers for the entertainment industry were members of the copyright association.

"In the autumn I received information that a lay judge could have similar connections. I sent these to the court and the judge was excluded in order to prevent a conflict of interest. It would have been reasonable to then review this situation as well," Althin told Sveriges Radio.

Speaking to the BBC, Sven-Erik Alhem - a former senior attorney in Sweden - said the judge had made an error of judgement, but a retrial was unlikely.

"The judge should have told the parties of his other engagements. Had he done that then they could make a decision on whether they wanted him as a judge in their case.

"I'm not sure the superior court could say that this was unfair, but had he been open then it wouldn't have been an issue," he said.

Rick Falkvinge, leader of the Swedish Pirate Party, told the BBC the judge had made an "unforgiveable" decision.

"This is corruption and judicial decay at an unforgiveable level.

"The judge in one of Sweden's most high profile cases ever is also a member of an interest organisation for one side and associates with the prosecution trial lawyers in his free time? That is inexcusable corruption," said Mr Falkvinge.

The Pirate Bay file-sharing website was set up in 2003 by anti-copyright organisation Piratbyran, but for the past five years it has been run by individuals.

Millions of files are exchanged using the service every day.

No copyright content is hosted on The Pirate Bay's web servers. The site hosts BitTorrent links to TV, film and music files held on its users' computers.

Ponovno suđenje za Pirate Bay


Advokati četiri osnivača popularnog torrent sajta The Pirate Bay zatražili su ponovno suđenje navodeći da bi u slučaju trenutnog sudije postojao sukob interesa. Sudija Tomas Norstrom, koji je član švedske asocijacije za zaštitu autorskih prava i koji je direktor švedske asocijacije za zaštitu industrijske svojine, navodi da nijedna aktivnost koja je vezana za ovo suđenje ne konstituiše nikakav konflikt interesa. Međutim, advokati navodi da će Apelacioni sud doneti odluku o mogućem ponavljanju suđenja. Frederik Neij, Gottfrid Svartholm Warg, Carl Lundstrom i Peter Sunde osuđeni su zbog kršenja autorskih prava 17 aprila ove godine na jednogodišnje kazne zatvora.

Pirate Bay Founder Devises DDo$ Attack

Pirate Bay founder Gottfrid Svartholm (aka anakata) recieved a bill for the 30 million SEK that he, along with Peter Sunde (aka brokep), Fredrik Neij (aka TiAMO), and Carl Lundstrom, was fined in the verdict of the Pirate Bay trial just over three weeks ago. The bill inspired anakata to devise a plan involving sending money to Danowsky’s law firm, but not to pay the fine of course which they say will never be payed. Anakata’s clever plan is called internet-avgift, internet-fee in English. Anakata encourages all Internet users to pay extremely small sums around 1 SEK (0.13 USD) to Danowsky’s law firm, which represented the music companies at the Pirate Bay trial. The music companies will not benefit from this, instead it will cost them money to handle and process all the money.

The plan can be called a Distributed Denial of Dollars attack (DDo$). The plan is an away-from-keyboard DDoS attack. DDoS attacks involve lots of users overloading the victim with internet traffic damaging their ability to provide services. Money, instead of Internet traffic is used in this case. The victim is Danowsky’s law firm which represented the IFPI at the Pirate Bay trial.

A friend of anakata told Blog Pirate that the bank account to which the payments are directed has only 1000 free transfers, after which any transfers have a surcharge of 2 SEK for the account holder. Any internet-fee payments made after the first 1000, which includes the law firm’s ordinary transfers, will instead of giving 1 SEK, cost 1 SEK to the law firm. Since Danowsky & Partners Advokatbyrå is a small firm, all the transactions are handled by hand. Handling all payments will be time consuming, costing the law firm in productivity. Maybe it will even affect their success in other cases.

Additionally if after paying the internet-fee you determine that your payment was erroneous, Swedish law states that you can request the money back, putting an additional load on Danowsky’s law firm.

Since the Pirate Bay crew was provided with such clear, logical, and well explained methods for calculating the damages in the trial, an explanation on how the internet-fee was calculated is provided. Use the formula below, substituting anything anywhere, to check that the internet-fee really is 1 SEK.



The name internet-avgift, as well as the layout of the site is based on tv-avgift and they layout of its site. Radiojanst, a state owned company, is responsible for collecting TV license fees in Sweden.

Pirate Bay site sold to game firm

File-sharing site The Pirate Bay has been sold to a Swedish gaming company.

Global Gaming Factory (GGF) has paid 60m kronor (£4.7m) to take over the site from its founders.

Once it has taken control, GGF said it would start paying copyright fees for the movies, music and games linked to via the site.

In April, The Pirate Bay owners were found guilty of promoting copyright infringement, fined 30m kronor and were sentenced to one year in jail.

New owner

The four men behind the site, Frederik Neij, Gottfrid Svartholm Warg, Carl Lundstrom and Peter Sunde, said they planned to appeal against the sentence.

The Pirate Bay is one of the most well-known file-sharing sites on the web. Many people use it to find copyrighted material such as TV shows, games and music tracks. The Pirate Bay does not host any of the pirated material itself.

"We feel that we can't take The Pirate Bay any further," Mr Sunde told the Swedish news agency TT. "We're in a bit of a frozen situation where there's not much happening and there are neither people nor money to develop things."

Half the money GGF will pay for the site will be in cash and the remainder in shares in the company.

"We would like to introduce models which entail that content providers and copyright owners get paid for content that is downloaded via the site" said Hans Pandeya, head of GGF in a statement.

"Content creators and providers need to control their content and get paid for it," he said.

GGF has not released details of how it will charge for the content downloaded via the site. The Pirate Bay will be handed over to GGF in August.

It is not clear how the deal affects the Video Bay - a video-sharing site set up by the people behind The Pirate Bay.

GGF specialises in software that helps run and maintain PCs used in cyber cafes and gaming centres.

Šokantna najava koja pre podseća na prvoaprilsku šalu govori o tome da je The Pirate Bay prodat. Samo jedan dan nakon stidljivih najava o streaming servisu koji bi The Pirate Bay trebao da pokrene, objavljeno je da će sajt biti prodat kompaniji Global Gaming Factory X. Ova firma za sebe tvrdi da je vlasnik najveće mreže internet kafea i gejming centara na svetu. Administratori The Pirate Bay sajta, koji je u poslednje vreme bio u žiži pažnje zbog sudskih procesa koji se vode zbog tužbi zabavne industrije, je prodat za ukupno 7,8 miliona dolara. Velike filmske i muzičke kompanije su poslednji put tražile preko 12 miliona dolara, a četiri Šveđana administratora sajta su osuđeni na po godinu dana zatvora. Trenutno se vodi žalbeni postupak.

Yes, it's true.

News reached the press today in Sweden - The Pirate Bay might get aquired by Global Gaming Factory X AB.

A lot of people are worried. We're not and you shouldn't be either!

TPB is being sold for a great bit underneath it's value if the money would be the interesting part. It's not. The interesting thing is that the right people with the right attitude and possibilities keep running the site.
As all of you know, there's not been much news on the site for the past two-three years. It's the same site essentially. On the internets, stuff dies if it doesn't evolve. We don't want that to happen.

We've been working on this project for many years. It's time to invite more people into the project, in a way that is secure and safe for everybody. We need that, or the site will die. And letting TPB die is the last thing that is allowed to happen!

If the new owners will screw around with the site, nobody will keep using it. That's the biggest insurance one can have that the site will be run in the way that we all want to. And - you can now not only share files but shares with people. Everybody can indeed be the owner of The Pirate Bay now. That's awesome and will take the heat of us.

The old crew is still around in different ways. We will also not stop being active in the politics of the internets - quite the opposite. Now we're fueling up for going into the next gear. TPB will have economical muscles to let people evolve it. It will team up with great technicians to evolve the protocols. And we, the people interested in more than just technology, will have the time to focus on that. It's win-win-win.

The profits from the sale will go into a foundation that is going to help with projects about freedom of speech, freedom of information and the openess of the nets. I hope everybody will help out in that and realize that this is the best option for all. Don't worry - be happy!

‘Brokep’ Quits Pirate Bay

Peter Sunde, one of the four co-founders of The Pirate Bay, said Monday he is abandoning ship.

Sunde, the BitTorrent tracker’s spokesman, and his fellow colleagues each are facing a year in prison following their spring convictions for facilitating copyright infringement. They remain free pending the outcome of an appeal of their Stockholm convictions.


The departure of Sunde, known online as “brokep,” perhaps is the strongest indication to date that the proposed $7.7 million sale of The Pirate Bay to a Swedish software concern is to be completed within weeks as planned.

Global Gaming Factory, its buyer, claims the 5-year-old Pirate Bay will become a legitimate, pay-to-play site for media such as movies, software, music and games. The goal, however lofty it sounds, is to convert the site’s 20 million pirates into fee-paying consumers.


“Today marks the end of a small era for me, but I am simply leaving a role in order to be a person instead,” Sunde said.

He said, “a book is waiting to be finalized and many more books are waiting to be read.”

If he loses his appeal, he’ll have plenty of time to write that book.
